What is Divorce Mediation?
Divorce mediation is a process designed to help couples resolve their conflicts without going to court. Through mediation, a divorcing couple can find a fair and practical way to end their marriage, divide their property and, if children are involved, continue to parent them together as sensibly as possible.
What is the Main Goal of Mediation?
The main goal in mediation is for all parties in a dispute to find a solution that will work for them in the long term. Mediation focuses on the future and not the past.
What is the role of an Attorney/Mediator?
An attorney mediator mediates with an understanding of the law and can provide the parties with information on how the current status of the law applies to their situation. The mediator helps the parties fashion their own agreement. This agreement may follow the law or be a creative alternative which meets the parties underlying interests.
The attorney mediator is neutral and does not represent or advocate for the interests of either party. The mediator makes sure all of the issues surrounding the divorce are addressed, especially the needs of the children. The mediator also ensures any agreements reached are fair and just. Mediated agreements are legally enforceable in a court of law, just as agreements reached through litigation are.
